District Court Orders FDA to Implement FSMA Regulations

The U.S. District Court for the Northern District of California recently granted the Center for Food Safety’s (CFS) Motion against the Food and Drug Administration (FDA) , in which CFS claimed that the USDA failed to enact regulations mandated under the Food Safety and Modernization Act of 2010 (FSMA) within the statutory deadlines.  In its April 22, 2013 decision, the Court ruled that the two parties must agree to and submit an FSMA implementation timeline by May 20, 2013.

In a press release, CFS attorney George Kimbrell commented that the Court’s ruling is a victory for public health.  “Every day without the FSMA regulations is another day where consumers are at unnecessary risk,” he said. “Because of this decision, our food will soon be safer from e coli and other threats.”
